Ken Podpeskar concentrates his practice on compliance counseling, spill reporting and remediation, Superfund cleanups, property transfers, and solid and hazardous waste issues. Prior to becoming an attorney, Ken worked as an engineer for eight years at the Minnesota Pollution Control Agency, where he was involved in both the hazardous and solid waste programs. With over 25 years of experience as an attorney, Ken has assisted clients to better understand how to maintain compliance with environmental regulations by focusing on the client’s individual manufacturing operations. He has worked with clients on spill reporting procedures, spill plan preparations, emergency response actions, solid and hazardous waste compliance, and PCB and tank regulations at the county, state and federal levels. Ken also has worked extensively with corporations and financial institutions on properly addressing environmental issues arising in corporate or property acquisitions or sales. He routinely conducts facility compliance audits by actually making an onsite visit and reviewing facility records to prepare the site for regulatory inspections. He also has coordinated the establishment of corporate compliance programs for a number of clients. Ken has trained clients for and has coordinated responses to multimedia inspections by the Environmental Protection Agency (EPA). He has negotiated settlememt agreements with EPA and state regulatory agencies across the country and has developed approaches with state and local agencies on innovative methods regarding waste, tank and cleanup requirements under EPA’s Project XL Program. In addition, Ken was actively involved in creating and executing the Printing Industry of Minnesota Partnership Agreement with the Minnesota Pollution Control Agency. Ken received his Juris Doctor degree, magna cum laude, in 1990 from William Mitchell College of Law, where he was executive editor of the William Mitchell Law Review. He received his undergraduate degree, with distinction, from the University of Minnesota in 1980. Prior to joining The Evironmental Law Group, Ken was a partner at Oppenhiemer Wolff and Donnelly LLP and co-founder of Bloomberg & Podpeskar LLP. He also was an adjunct professor of environmental law at William Mitchell College of Law and is a member of the American Bar Association; Minnesota State Bar Association; and Hennepin County Bar Association, Environmental Law Section.
