On September 21 and 22, 2017, ELG will host the annual conference of the Environmental Law Network (ELN). ELG is proud to be a member of the ELN. ELN is an environmental law firm network that makes local representation available nationwide. Through ELN, more than 250 environmental attorneys share ideas, information, experiences, and contacts to increase the value of legal representation for their respective clients. ELN also has foreign affiliates in Argentina, Brazil, Canada, France, Italy, Mexico, the United Kingdom and Spain. Leaders in each of the member firms average more than 20 years of experience in the field. The annual conference will be held at the Loews Hotel in Minneapolis and will feature numerous speakers including Minnesota Pollution Control Agency Commissioner, John Linc Stine.

Members of the Air & Waste Management Association – Upper Midwest Section have elected ELG attorney Bill Hefner as a Director of the Board of the A&WMA-UMS. Bill—who replaces outgoing ELG attorney Jon Bloomberg on the Board—will serve a three-year term beginning June 2017. The mission of A&WMA is to assist in the professional development and critical environmental decision-making of its members to benefit society and its core purpose is to improve environmental knowledge and decisions by providing a neutral forum for exchanging information.

For over 35 years, the Upper Midwest Section (UMS) of the Air & Waste Management Association (A&WMA) has provided a forum for Association members who live in Minnesota, Western Wisconsin, and the Dakotas to meet, learn, and network.
ELG attorney Susan Wiens receives MSBA’s Professional Excellence Award, along with Ken White, for their service and leadership as Co-Chairs of the Alternative Legal Models Task Force. The Task Force investigated and proposed to the MSBA Assembly innovative means to provide legal services to those that cannot otherwise afford legal services or qualify for legal aid. This honor recognizes attorneys who strive to meet the many responsibilities of a lawyer, including efforts to improve the administration of justice, the practice of law, and access to justice for the benefit of the community.

Each year, the Awards honor innovative projects that have achieved “extraordinary environmental results by harnessing the power of partnerships.” Seven individuals or groups received awards for their work, while the Environmental Initiative celebrated its own 25th anniversary of bringing together nonprofit, business and government leaders to solve environmental problems.

ELG attorneys Jon Bloomberg and Bill Hefner once again offered a half-day legal workshop to Air and Waste Management Association—Upper Midwest Section members and the general public on April 5, 2017, at the Wilder Foundation in St. Paul, MN. At this year’s workshop—entitled “Administrative Law for Environmental Professionals”—Jon and Bill presented on such topics as the legal basis of regulations, the difference between rules and guidance, and key considerations in managing compliance risk.
ELG attorneys Jeremy Greenhouse, Bill Hefner, and Ken Podpeskar will present at the 2016 Midwest Environmental Compliance Conference to be held in Chicago on November 1-3, 2016. Jeremy will be co-presenting a talk on Antidegradation: A Practical Guide with Melisa Pollak (Barr). Bill will be moderating a panel discussion on EPA’s five-year strategic plan for environmental justice, featuring EJ. Alan Walts (EPA Region 5) and MPCA Commissioner, John Linc Stine. Ken will moderate and oversee the Minnesota Pollution Control Agency breakout session, which will feature MPCA staff members Don Smith, Sarah Kilgriff, and Aaron Luckstein. ELG attorney Susan Wiens will be speaking at a CLE on Wednesday, February 24, 2016, celebrating the 30th anniversary of Superfund. Sponsored by the Minnesota State Bar Association’s Environment, Natural Resources and Energy Section, the CLE will examine Superfund’s origins, its current effects on corporate behavior and real estate practices and its likely future. Susan will speak on the Natural Resource Damages component of Superfund. As Superfund site remedial actions mature, the DOJ and relevant Trustees are circling back to Responsible Parties seeking Natural Resource Damages that remain post cleanup. Susan will discuss the basic principles for recovery of Natural Resource Damages, potential defenses available to Responsible Parties and how Trustees obtain jurisdiction to recover damages.
